In the early stages of the bankruptcy process, regardless of the Chapter, the bankruptcy court will issue an automatic stay after you have filed a formal bankruptcy petition. This automatic stay is one of the essential components of the bankruptcy process, and will order all collection activities against you to stop immediately. This means that wage garnishments, phone calls and foreclosure proceedings will cease while your bankruptcy is pending. After the automatic stay has been ordered, you will have the much needed time to organize your finances, chart your unique Chapter 7 or Chapter 13 proceedings and prepare for your financial future.
